Ben will be updating listeners on the changes to remedies available in the ET and the relevant caselaw, including the recent Court of Appeal case in De Souza v Vinci Construction (UK) Ltd  EWCA Civ 879 which confirms that the Simmons v Castle uplift should be applied to awards for injury to feelings in the ET.
He will also be talking about the new guidelines for calculating pension loss (which are due to be published in August) and of course, he will discuss the implications of the recent Supreme Court case R (on the application of UNISON) v Lord Chancellor  UKSC 51 which has ruled that Tribunal fees are unlawful.
About the Presenter
Benjamin Gray is an experienced junior barrister with a practice encompassing employment, commercial, insolvency and public law. He has a busy practice with a significant amount of time doing advocacy in Courts and Tribunals.
He is experienced and good at conducting short-notice and complex advocacy, including in injunction proceedings and through duty schemes such as ELIPS and ELAAS. His experience ranges from high-value commodities arbitration through Judicial Review to complex whistleblowing and discrimination cases.
Benjamin was appointed to the Attorney General’s C Panel of Junior Counsel to the Crown in February 2017.
Benjamin is the General Editor of the Employment Tribunal Remedies Handbook.
